GIVEAWAY OFFICIAL RULES

NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY. A PURCHASE OR PAYMENT OF MONEY WILL NOT IMPROVE THE CHANCES OF WINNING.

 

  1. Eligibility

    The Stargate NFT by Mrs. Metal giveaway (the “Giveaway”) is intended for legal residents of the United States of America and Canada, who are at least eighteen (18) years of age or have reached the age of majority in their respective state/province of residence at the time of entry (the “Entrants”), and shall only be construed and evaluated according to applicable U.S. law, Canadian law, and applicable state/province law. Do not enter this Giveaway if you are not located in the United States or Canada or are otherwise ineligible to enter in accordance with these Official Rules at the time of entry. Employees, contractors, directors, their employees and officers of Fimi and their immediate family members and those living in their same households are not eligible. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein. One entry per person.

  2. Sponsor/Administrator

    The Giveaway is sponsored and administered by Fimi Market Inc., 16701 Melford Blvd., Bowie, Md 20715.

  3. Timing

    The Giveaway begins on September 15, 2022 at 12:01am Eastern Time ("ET") and ends on September 16, 2022 at 11:59pm ET (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for the Giveaway.

  4. How to Enter

    Participants are entered by liking the giveaway announcement post on Twitter, retweeting the giveaway announcement post, and following both @FIMI_Market and @Mrsmetalcrazy22 profiles on Twitter. Sponsor reserves the right to add to/change and/or cancel any or all of the above locations at any time without notice. Sponsor is not responsible for late, lost, illegible, incomplete, misdirected, or duplicate entries. All entries become the exclusive property of Sponsor, and none will be acknowledged.

  5. Grand Prize Drawing

    Sponsor’s decisions as to the administration and operation of the Giveaway and the selection of the potential winner(s) is/are final and binding in all matters related to the Giveaway. Sponsor will randomly select the potential Giveaway winner from all eligible entries received during the Promotion Period, on or around September 23, 2022 and announced on Fimi social media platforms, including but not limited to Twitter. The winner will be notified by Direct Message on Twitter. If the winner cannot be contacted or fails to respond within five (5) business days, potential winner forfeits prize. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.

  6. Prize

    There will be one (1) Grand Prize. The Grand Prize is one (1) Stargate NFT created by artist, Mrs. Metal.  Winner is responsible for all taxes and other fees associated with prize, including federal/state income tax on value of prize. Prize will be delivered within ten (10) business days, to the Stellar wallet of the winner’s choice, after successful contact and confirmation of eligibility of the winner has been established.

  7. General Conditions

    If for any reason the operation or administration of this Giveaway is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs, (ii) tampering, unauthorized intervention, (iii) fraud, (iv) technical failures, or (v) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and award the Prize using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be tampering or attempting to tamper with the entry process or the operation of the Giveaway or Sponsor’s Website; or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

  8. Prize Restrictions/Conditions

    Prize is non-transferable, non-exchangeable and non-refundable. No cash or other prize substitution, except by the Sponsors, in whole or in part, in their sole discretion. The Grand Prize Winner(s) is/are solely responsible for any taxes on prize and any expenses not listed herein relating to acceptance and use of a prize. Sponsor shall not be responsible for delays in delivery of the prize. Sponsor, however, shall use all reasonable efforts, subject to availability, to deliver the Grand Prize within one hundred twenty (120) days after receipt of the winner’s Affidavit of Eligibility, Liability & Publicity Release and other requested information. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner(s) is/are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning the prize depends on the number of eligible entries received during the Promotion Period.

  9. Should a selected Winner be a Canadian citizen

    the selected Entrant must answer correctly without assistance of any kind, whether mechanical, electronic, or otherwise, a mathematical skill-testing question posed by email or telephone. If the selected Entrant fails to correctly answer the question, he/she will be disqualified, and another Entrant will be randomly selected. The potential Winner(s) who correctly answers the skill-testing question will be notified by telephone and/or mail and/or email at the Sponsors’ discretion using the contact information provided at the time of entry or notification of selection. If the potential Winner is determined to be less than the age of majority in his/her province of residence, then the potential Winner will be disqualified, and an alternate winner will be selected in their place.

  10. Release

    By receipt of any prize, winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize.

  11. Publicity

    Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration or notification of permission.

  12. Disputes

    All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants, Administrator, and Sponsor in connection with the Giveaway shall be governed by and construed in accordance with the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other province’s, states’ or jurisdiction’s laws.  By participating in the Giveaway, Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Giveaway, shall be resolved individually without resort to any form of class action; (ii) any judicial proceeding shall take place in a competent court within the State of Maryland; (iii) any and all claims, judgments , and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event will attorney fees be awarded or recoverable; (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (v) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief.

  13. Severability

    The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

  14. Miscellaneous

    These Official Rules contain full and complete understanding with respect to the Giveaway and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsor and Administrator. The waiver by Sponsor or Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant.

  15. Winners List Request

    To request confirmation of the name, city, and state of residence of the Winner(s), please send a self-addressed, stamped business-size envelope, by [date 6 months after end of giveaway) to: Fimi Market Inc.
